Chapter 7 & Personal Bankruptcy in Boston

If debt has become unmanageable, Chapter 7 can wipe the slate clean and give you a genuine fresh start — the most complete path out from under unsecured debt.

Chapter 7 is the most common form of consumer bankruptcy. Parks Law Offices was founded as a bankruptcy practice, and we file Chapter 7 cases regularly at competitive, transparent fees.

What Chapter 7 can do

Chapter 7 — sometimes called "liquidation" bankruptcy — eliminates most unsecured debts, including credit cards, medical bills, personal loans, and many judgments. The moment you file, the automatic stay stops most collection activity: creditor calls, lawsuits, wage garnishment, and foreclosure proceedings must pause while your case proceeds. Most people complete the process in a matter of months and emerge debt-free on their dischargeable debts.

Will I lose my property?

Usually not. Massachusetts and federal exemptions protect much of what people own, and many filers keep their home, car, and personal belongings. Before you file, we review your specific assets against the available exemptions so you know exactly what to expect.

Do I qualify? (the means test)

Eligibility for Chapter 7 generally depends on the means test, which compares your income to the Massachusetts median and weighs your expenses and debts. If your income is below the median you typically qualify; if it's higher, the analysis is more involved — and Chapter 13 may be the better route. We'll evaluate where you stand at your free consultation.

The process, step by step

  1. Free consultation — we review your debts, income, and assets.
  2. Preparation & credit counseling — required pre-filing counseling, plus gathering your documents.
  3. Filing — your petition is filed and the automatic stay takes effect.
  4. 341 meeting of creditors — a short, routine meeting with the trustee.
  5. Discharge — your eligible debts are wiped out, typically a few months after filing.

Frequently asked questions

Which debts are not erased by Chapter 7?

Some debts generally survive bankruptcy — for example, most student loans, recent taxes, child support and alimony, and certain court-ordered obligations. We'll tell you which of your debts are dischargeable.

Will bankruptcy ruin my credit forever?

No. A filing affects your credit for a period of time, but many people begin rebuilding their credit soon after discharge — often in a stronger position than they were while drowning in debt.

How much does Chapter 7 cost?

Our fees are competitive and discussed openly at the first meeting, separate from the court's filing fee. The initial consultation is free.

Can creditors keep calling after I file?

The automatic stay legally requires most creditors to stop collection activity once you file. If they don't, there are remedies.
